Privacy Policy


Your privacy matters at John C. Fremont Healthcare District.

We have always been committed to protecting individuals' health information and will continue its commitment by ensuring compliance with Federal and State laws that recognize and protect the rights of persons to be free of unwarranted intrusion upon their private affairs. The California Constitution contains a provision which expressly recognizes the individual's right of privacy (California Constitution, Article I, Section 1). The Confidentiality of Medical Information Act [Civil Code Section 56 et seq.] (referred to herein as the "Act") states that persons receiving health care services have a right to expect that the confidentiality of individually identifiable medical information in the possession of or derived by health care providers will be reasonably preserved. The Act establishes the general rule that a provider of health care must not share, sell, or use or disclose medical information regarding a patient unless prior written authorization for the disclosure has been given by a patient or his or her legal representative. Title 22, California Code of Regulations, [§70707(b)(8)] requires that a general acute care hospital protect the patient's right to confidential treatment of all communications and records pertaining to his or her care and stay in the hospital. Federal regulations applicable to hospitals participating in the Medicare and Medicaid (Medi-Cal) program contain a similar general statement of a patient's right to privacy [42 C.F.R. Section 482.13]

It is the policy of the John C. Fremont Healthcare District that the maintaining of privacy and security of protected health information is a duty of all employees, medical staff appointees, board members, business associates, volunteers, regardless of whether the individual in question works directly with such information. Individuals who have access to protected health information must ensure that such information, in whatever form it exists, is handled strictly in accordance with this Policy and applicable legal, accreditation and regulatory requirements regarding safeguarding confidential information.

It is further the policy of the John C. Fremont Healthcare District that the disclosure of protected health information is strictly prohibited without the written authorization of the patient or legal representative of the patient unless otherwise allowed by law.

The John C. Fremont Healthcare District respects the following privacy rights:

To receive a paper copy of the District's Notice of Privacy Practices
To request restrictions on the uses and disclosures of health information
To request to receive confidential communication
To access their protected health information for inspection and/or copying
To amend their health information
To request an accounting of disclosures of health information
